MEMORANDUM OF AGREEMENT between the Rev. James Marchant2, Dr. Alfred Russel Wallace O.M. and Mr. John Murray for themselves and their respective executors administrators and assigns, with regard to the compilation and publication of a work at present entitled "Darwin and Wallace."

1. Dr. Wallace agrees to assist Mr. Marchant in every way possible in the compilation of the work and to allow his name to appear with Mr. Marchant's on the title page.

2. Mr. Murray agrees to bear the entire cost and risk of printing and publication in the British Empire including such maps and illustrations as may be agreed between him and the author

Except only in the event of the cost of corrections in proofs exceeding 25% of the cost of composition when such excess shall be borne by Mr. Marchant; and the cost of an index (1½ to 3 guineas for a one volume boo0k) if Mr. Merchant prefers not to make it himself.

3. Mr. Murray agrees to pay Mr. Merchant a royalty on the advertised price of all copies sold of the full price Home edition as follows: -

On the first 1000 copies ten per cent rising thereafter to twelve and a half per cent but if not less than 1000 copies shall have been sold within the first three months after publication the royalty shall be raised to fifteen per cent on all copies sold

4. In the case of a Colonial edition at a cheap rate or of sheets sold to America Mr. Murray agrees to pay to Mr. Merchant a royalty [2] of fifteen per cent of the net proceeds of all such sales.

5. On account of the royalties stated above in Clauses 3 and 4 Mr. Murray agrees to pay Mr. Marchant the sum of £50 on the day of publication.

6. Mr. Murray also agrees to pay Dr. Wallace a royalty of five per cent on the advertised price of all copies of the full price Home edition.

7. Eight free copies shall be presented to Mr. Marchant and four to Dr. Wallace and they purchase further copies at two-thirds of the published price.

8. Accounts shall be made up to April 30 and cheques shall be payable in the following August and in the event of any share of the cost of corrections falling on Mr. Marchant under Clause 2, vouchers for all payments and receipts can be seen on request.

9. The copywrite of the work shall remain the property of Mr. Marchant but the rights of publication shall be vested in Mr. Murray so long as he faithfully acts ups to this understanding.

10. When the book has ceased to sell Mr. Murray shall be at liberty to dispose of any copies left on hand as a "remainder" at a reduced price after consultation with Mr. Marchant[.] In such a case a royalty of fifteen per cent on the actual sum received by Mr. Murray shall be paid to Mr. Marchant in lieu of the royalties specified above.

11. Mr. Marchant guarantees that the said work is in no way a violation of any existing copyright or libellous and undertakes [3] to hold the publisher harmless from any claim or proceeding that may be established or brought on the ground that the said work does violate another copyright or contain libellous matter.

12. If at any time not less than two years from first publication the sales of the original higher priced editions shall justify the publication of a cheaper edition Mr. Murray agrees to publish such an edition and to pay Dr. Wallace and Mr. Marchant such royalties as may be agreed on when the price of such cheaper edition is fixed.
